Terms of Use

Marble Rivals: Race Royale

Effective September 16, 2026. This is the whole agreement between you and Smooth Bird Studios LLC about the game.

The short version

Play the game, have fun, don't cheat or try to break it. Coins, gems and marbles live inside the game and are not property and not money. We may change or stop the game. If something goes wrong, email [email protected] before anything else — we would much rather fix it than argue about it.

The rest of this page is the same thing said carefully.

1. Who we are, and what you are agreeing to

Marble Rivals: Race Royale (the game) is published by Smooth Bird Studios LLC, c/o Northwest Registered Agent LLC, 418 Broadway STE N, Albany, NY 12207, USA (we, us). By downloading or playing the game you agree to these terms. If you do not agree, please delete the game — that is all it takes to end this agreement.

We license the game to you. We do not sell it to you. You get a personal, non-exclusive, non-transferable right to install and play it on Apple devices you own or control, for your own entertainment. Everything in the game — the code, the tracks, the marbles, the art, the music, the name — stays ours.

2. How old you need to be

The game is for a general audience and is not aimed at children under 13. If you are under the age at which you can agree to terms like these on your own, a parent or guardian has to agree for you and is responsible for your use of the game.

We do not knowingly collect personal information from children under 13. If you believe a child has given us something, email [email protected] and we will delete it. The Privacy Policy explains exactly what the game does and does not collect.

3. You do not need an account

The game plays as a guest. There is no sign-up, no email and no password, and the full game works with the device offline.

Because there is no account, your progress lives on your device. If you delete the game, reset the device, or lose the device, that progress is gone and we cannot get it back for you. When the optional Cloud Save feature is switched on, a copy of your save is kept for you — see the Privacy Policy for what that copy contains.

If you sign in to Game Center, that is your Apple account and Apple's terms govern it. We can show achievements through it; we do not run it.

4. Playing fair

The game is a race. These are the things that stop it being one, and you agree not to do them:

If you do these things we may reset the affected progress, remove items that were not earned, or stop you using the online parts of the game. We will aim to be proportionate and we will tell you what happened if you ask.

5. Coins, gems, marbles and chests

Nothing you collect in the game is money, and none of it can be turned back into money.

You get a limited, revocable, personal licence to use these items inside the game. You do not own them. They have no cash value, cannot be sold, traded or transferred outside the game, and cannot be exchanged for money, goods or anything else of real-world value. They can change: we may rebalance prices, payouts and odds as the game is tuned, and we will not owe you a refund for a change in balance.

Some races charge a coin entry fee and pay a coin prize based on where you finish, and you may opt into a multiplier before a race starts. This is a game mechanic using in-game coins. No real money is staked and no real money or prize of real-world value can be won.

If your save is deleted — by you, by deleting the app, or by the Start Fresh button in Options — the items go with it.

When enabled

6. Purchases

There are no in-app purchases in this version of the game. The shop sells items for coins and gems that you have earned.

When real-money purchases are switched on, this is how they will work, and we will update the date at the top of this page before they are:

  • Apple takes the payment through your App Store account. We never see or hold your card details.
  • What you buy is the in-game item, delivered immediately. Because it is delivered immediately, it is not returnable by us.
  • Refunds are handled by Apple, under Apple's rules, through reportaproblem.apple.com. We cannot issue an App Store refund, but if a purchase failed to arrive, email us and we will make it right in the game.
  • Prices are set per territory by Apple and can change.
When enabled

7. Ads

There are no ads in this version of the game. When they are switched on they will be optional and rewarded — you choose to watch one to get something, and nothing is forced between you and a race you have started. We will update this page and the Privacy Policy before that happens.

8. Things that change

The game is live and it will keep changing. We may add, alter or remove tracks, marbles, modes, prices, payouts, odds and events; we may run events for a limited time; and we may eventually stop running the online parts, or the game itself. If we shut the game down we will give notice in the app where we reasonably can.

We may update these terms. If a change matters to you — anything about your money, your data or your rights — we will say so in the app, not only here. The date at the top always tells you when this page last changed. Continuing to play after a change means you accept it; if you do not, delete the game.

9. Your name and what you share

You can set a player name and share race cards out of the game. You keep whatever rights you have in what you make; you give us permission to show it inside the game where the feature needs it (for example, your name on a leaderboard or a shared card). Do not use a name or make a share you do not have the right to use.

10. What we do not promise

We build this carefully and we test it on real devices, but we cannot promise the game will be uninterrupted, bug-free, or that it will run on every device or every iOS version. The game is provided "as is" and "as available", to the fullest extent the law where you live allows.

To the fullest extent the law allows, we are not liable for lost progress, lost in-game items, lost time, or indirect or consequential losses. Where we are liable, our total liability to you is limited to the amount you actually paid us for the game in the twelve months before the claim — which, in this version, is zero, because the game is free and has no purchases.

None of this takes away rights you have as a consumer that cannot be taken away — including under EU and UK consumer law. If a part of this section is not allowed where you live, that part does not apply to you and the rest still does.

11. Ending it, and disagreements

You can end this agreement at any time by deleting the game. We can end it if you break these terms in a way that matters. Sections 5, 10 and 11 survive.

These terms are governed by the laws of the United States (State of New York), and the courts of the United States (State of New York) have jurisdiction — except where the law where you live gives you the right to bring a claim locally, which it may, and which we do not try to take away.

Please email us first. Most things people take to a dispute are things we would simply have fixed: [email protected].

12. Apple

You downloaded the game from Apple's App Store, so a few things are true about Apple specifically:
